Personal Injury Our firm offers representation in many types of injury cases, some of which include automobile accidents, premises liability, slip and fall accidents, animal attacks, assault, defamation, product liability, and wrongful death. Personal injuries and other civil wrongs are referred to in the legal community as "torts." Torts fall into various categories. Intentional torts are those injuries that result when a person intends the results of his actions. Negligent torts occur when one person's carelessness results in damage to another or another's property. Finally, a strict liability tort results when a situation is considered potentially extremely dangerous, someone is injured and the person responsible for creating the situation is considered liable even though they may not have been careless. If you find yourself or a loved one the victim of another person or entity's actions, whether by negligence, intent or based on strict liability, contact us to schedule a FREE case evaluation. We can aggressively pursue your case and ensure that you receive the compensation that you deserve. All personal injury cases are handled on a contingency fee basis, meaning that there are NO legal fees unless YOU recover. Social Security Disability Almost everyone who receives a paycheck and has had taxes withheld knows that a portion of those taxes represent payment toward Social Security. If something happens to you where you become disabled or unable to work, you, and in some cases your dependents, are entitled to receive cash benefits in an amount based upon how much you or they have worked and earned in the past. Social Security Disability is a benefit received from the Social Security Administration by disabled workers, and is some instances, their dependents. The process to obtain Social Security Disability benefits is lengthy, highly technical, and complicated. In order to receive disability benefits, a determination must be made that the applicant is “disabled”. Whether an applicant meets the definition of being “disabled” is a legal decision based upon the claimant’s medical history, which must be thoroughly documented in the applicant’s medical records. Factors that influence a legal finding of disability include the claimant’s age, education, work experience, compliance with medical treatment, daily activities and the nature and extent of treatment. Unfortunately, even in situations where an applicant’s disability is clearly and thoroughly documented, benefits may nonetheless be denied. If this occurs, and the applicant wishes to appeal the Social Security Administration’s denial of disability benefits, the applicant must request a hearing before an Administrative Law Judge. Because of the contested and complex nature of these administrative hearings, it is recommended that the applicant be represented by an experienced attorney to assist and guide them through the hearing process. Probate & Estate Administration At Sullivan & Sullivan, we have significant experience in the area of Probate & Estate Administration. Probate is the legal process by which a person’s debts are paid and assets are distributed upon death. Estate Administration includes the probate process as well as non-probate transfers of the deceased’s assets. Laws governing the distribution of a deceased’s estate are highly technical and vary by state. Therefore, advice and representation from an experienced attorney is always recommended. Our firm has been providing skilled and effective representation to individuals and families by assisting them with their legal affairs after their loved one has passed away. Services provided by us include probating wills, administering estates, payment of creditors, and overseeing the distribution of the decedent’s assets. Bankruptcy A significant portion of our practice is devoted to Consumer Bankruptcy. We represent individuals and businesses in Chapter 7 and 13 bankruptcy proceedings. Both are forms of protection from creditors offered under the Bankruptcy Code. Chapter 13 or Individual Debt Adjustment allows the debtor to rearrange their financial affairs by repaying a portion of their debts. Under a typical Chapter 13 plan, the debtor makes monthly payments to a bankruptcy trustee, who then distributes the money to the debtor’s creditors. Chapter 7 or liquidation is for debtors who do not have the means to perform under Chapter 13.Most debts are wiped discharged and the debtor pays nothing back to these creditors. If you are contemplating filing for Bankruptcy, contact us today. We are experienced Bankruptcy attorneys and can review your financial situation, advise you of your options, and prepare the necessary filings to initiate your bankruptcy proceeding.
